These Terms & Conditions ("Terms") govern your use of madmaheshwar.com and any trek, tour or pilgrimage booking made through the Site or through madmaheshwar.com ("we", "us", "our"). By browsing the Site or making a booking, you agree to be bound by these Terms.
1. About Our Services
We offer information, planning assistance and booking services for Himalayan treks and pilgrimages, including the Madmaheshwar Yatra and related Panch Kedar routes, along with associated services such as guides, porters, accommodation, permits and transport, either directly or through local partners.
2. Booking and Payment
- Bookings are confirmed only after receipt of the required advance payment as communicated at the time of booking
- The balance payment is due [2 days] before the trip start date, unless otherwise agreed in writing
- Prices are subject to change until a booking is confirmed with payment; confirmed bookings will honour the quoted price unless government taxes, permit fees or third-party costs change
- Payments are processed through our third-party payment gateway; we do not store your full card or banking credentials
3. Cancellation and Refund Policy
Unless a specific package states otherwise:
- Cancellations made [30+ days] before departure: 50% refund
- Cancellations made [20 days] before departure: 15% refund
- Cancellations made within [15 days] of departure, or no-shows: non-refundable
- Refunds, where applicable, are processed within [7 days] to the original payment method
- We are not liable for cancellations, delays or changes caused by weather, landslides, road closures, government restrictions or other events beyond our control (see Section 6)
4. Traveller Eligibility and Health Declaration
Himalayan treks, including Madmaheshwar, involve high-altitude walking, uneven terrain and variable weather. By booking, you confirm that you (and any minors or elderly members in your group) are in suitable health and physical condition for the chosen trek, and you agree to disclose any relevant medical conditions before departure. We may recommend or require pony, palki or alternate arrangements for travellers who need them.
5. Itinerary Changes
Itineraries are planned in good faith but may be modified before or during the trip due to weather, trail conditions, government or forest department restrictions, or safety concerns. We will make reasonable efforts to inform you of significant changes and offer suitable alternatives where possible.
6. Force Majeure
We are not responsible for delay, cancellation or failure to perform any part of a booking caused by events beyond our reasonable control, including but not limited to natural disasters, extreme weather, landslides, road blockages, epidemic or government-imposed travel restrictions.
7. Traveller Responsibilities and Code of Conduct
- Follow the instructions of your guide or trek leader at all times, particularly regarding safety and pacing
- Carry valid government-issued identification and any required registration or permit documents
- Respect local customs, temple rules, and the natural environment along the route
- Avoid actions that endanger yourself, other travellers, staff, or local communities
8. Assumption of Risk and Limitation of Liability
You acknowledge that high-altitude Himalayan trekking carries inherent risks, including but not limited to altitude sickness, injury, adverse weather and terrain-related hazards. To the maximum extent permitted by law, Madmaheshwar.com and its guides, partners and staff shall not be liable for any injury, illness, loss, or damage arising from participation in a trek or tour, except where caused by our proven gross negligence or wilful misconduct.
9. Travel Insurance
We strongly recommend that all travellers, especially on high-altitude treks, obtain comprehensive travel insurance covering medical emergencies, evacuation and trip cancellation before departure.
10. Intellectual Property
All text, images, itineraries, logos and content on this Site are the property of Madmaheshwar.com or its licensors, unless otherwise credited, and may not be reproduced or used without prior written permission.
11. User-Generated Content
If you submit reviews, testimonials, photos or comments to the Site, you grant us a non-exclusive, royalty-free licence to display and use that content for promotional purposes, and you confirm the content does not infringe any third party's rights.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Any disputes arising out of or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts at [Dehradun / Harrawala], Uttarakhand.
13. Changes to These Terms
We may revise these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of the Site or a new booking after changes are posted means you accept the updated Terms.
